Note that “TerraShops,” “we,” “us,” “our,” or “the platform,” refers to the same entity which is the TerraShops LLC company and which will be referred to as the “The Services” in this policy.” Bear in mind, that this policy is not applicable to third party policies (this includes members who sell using the Services or API users) who may also collect or receive data in connection with your use of the Services.
You agree that by using TerraShops Services, you acknowledge that you permit TerraShops to use your information in the United States, and every other country where TerraShops operates. Bear in mind that the privacy laws and regulations in specific countries (including the rights of authorities to access your personal data), may be different from those of your country of residence.
Information We Collect or Receive
In the process of providing you with our Services, we collect or receive your personal information in a variety of ways. The categories of personal information we collect from you include:
Information We Automatically Collect
We automatically collect some specific information (device information) when you visit our website/platform. Such information includes: info about your web browser, IP address, time zone, and some of the cookies installed on your device. Furthermore, as you surf through the Site, we collect information about the individual web pages or products viewed by you, we also save what websites or search terms/keywords that referred you to the Site, as well the information about how you interact with these pages and the TerraShops Site.
When you visit the TerraShops Platform, we also automatically collect device-specific information when you install, access, or use our Services – this includes information such as the hardware model, operating system information, app version, app usage and debugging information, browser information, IP address, and device identifiers.
All this information is used in preventing fraud and keeping the Services secure. We also use it to analyze and understand how the Services work for members and visitors, and to provide advertising across your devices, and to ensure a more personalized experience for you.

Registration, Account Setup, Service Usage
We require you to submit a valid email address when registering with us to facilitate your use of our Services. In addition, you’ll also need to provide a name to your account – this can be modified via your account settings. We may also require more information, such as a shop name, billing and payment information (including billing contact name, address, telephone number, credit card information), a telephone number, and/or a physical postal address, to enable us to provide a specific service to you. For example, if you are purchasing an item, we need a physical postal address to get the item delivered to you.
As a seller on TerraShops, we may require your full name, social security number, identification ID or tax ID, date of birth, bank account information, photograph, credit card information, and/or other proof of identification in order to verify your identity, provide you with our Services, and to ensure compliance with the applicable law. In the case of both buyers and sellers, TerraShops needs this information from you to provide you with the Services. We may store your credit card information to facilitate billing and payments (if you are resident in certain countries, you may decide to save your credit card information to make future checkout easier). If you’re a buyer on TerraShops resident in the EU, Norway, Iceland, or Liechtenstein, you may receive an authentication notification of your payment method (you’ll have to respond to a prompt from your card issuer such as by providing a passcode, question or password) when placing an order.
We may reach out to shop owners and buyers confidentially to request for more information about their shops or listed products on TerraShops and to ensure compliance with our policies and applicable laws respectively.
The use of certain products or services on the TerraShops platform may be subject to completing an application process. Please bear in mind that the information you provide during this process will not be available to the public (unless we specify otherwise) and we shall only use them for internal TerraShops and our service provider purposes.
In connection with your account and activity, you are at liberty to provide your name and other personal data - including birthday, gender, location information). If you wish, you may edit or remove this information by going to your account settings and affecting it. The name associated with your account is publicly displayed and connected to your TerraShops activity – you may modify this name at any time through your account settings. The following are information that may be seen by other members on TerraShops: the date you joined TerraShops, your ratings and review information, your profile information, your listed products, your shop pages and policies, your comments in TerraShops community spaces, and information you decide to share via social networks.
Data from TerraShops Vendors and Suppliers
Our suppliers and vendors also provide us with information about you – this includes customer service interactions, payment information, shipping information, and information shared in TerraShops.
Data from Advertising and Marketing Partners
Our advertising and marketing partners also provide information about you to us. Examples of such information may include attribution information via cookies and UTM tags in URLs to determine where a visit to TerraShops comes from, marketing emails and advertisements responses, offer responses, and audience information from partners who you have given consent to share that information with us.
Information from Third Parties
You may choose to connect to the TerraShops Services or register a TerraShops account through an external third-party application, such as Facebook, Twitter or an app developed using TerraShops API. Please note that this is optional and should you choose to connect your account to a third-party application, TerraShops can receive information from such applications.
To connect with you, we may collect public information such as info needed to communicate with you via social media. We need this information in order to provide you with TerraShops Services. You are also free to share some of your TerraShops activity on certain social media platforms connected to your TerraShops account - you can revoke your permission anytime in your account settings. Some third-party applications that you may use in creating or signing in to your account may provide you with the option of discontinuing the receipt of messages from us or may allow you to forward messages from TerraShops to another email address. Please be aware that we may suspend or terminate your account if we are unable to send you critical messages in connection with your account.
We also receive or obtain information from non-TerraShops members in connection with the TerraShops Services such as when a non-member chooses to subscribe to a TerraShops newsletter, a member invites a non-member to visit the Site, a non-member engages in a transaction, a member sends a gift card code to a non-member, or a non-member uses Guest Checkout to make a purchase.
Note that we only use Non-member information only for the purposes disclosed when such information was submitted to us, for the functioning of the TerraShops Platform, as disclosed in the “Information Uses, Sharing, & Disclosure” Section below, or to facilitate an action authorized by a member or the non-member.
Messages from TerraShops
TerraShops may need to contact you from time to time; therefore, you may receive messages from us via email, TerraShops Messages, or by push notifications for different reasons such as marketing, transactions, and service update purposes. If you do not wish to receive push notifications, you can disable them through your device settings. You may also wish to opt out of receiving marketing communications via email or Messages in your account settings or by following the unsubscribe link in any marketing email you receive. To receive messages from us, your account is required to have a valid email address attached to it. Upon your request, we may also contact you by telephone to provide member support or for transaction-connected purposes.
Furthermore, with your consent where required by applicable law, you may also receive an SMS (or similar) message, or we may contact you by telephone, in order to provide you with customer support, for research or feedback, or to provide you with information about products and features that may interest you. If you wish to update your contact preferences, you can do so in your account settings.
Certain messages from TerraShops are service-related and as such, are important for members and Guest Checkout users. You agree that TerraShops can send you non-marketing emails, TerraShops Messages, or messages which are related to transactions, your account, security, or product changes. These types of messages include an email address confirmation/welcome email you get upon registering your account with TerraShops, notification of an order, service availability, modification of important features or functions, relaying Messages with buyers, and correspondence with TerraShops Support team.
You agree (in some jurisdictions and certain instances, by an additional unambiguous consent) to receive marketing emails and messages from us when you register for a TerraShops account, subscribe to a newsletter, or provide us with your email address or phone number such as for a Guest Checkout purchase. You can opt-out at any time by clicking the unsubscribe link in the marketing emails or messages (as a TerraShops member, you can control these from your TerraShops account settings).
How we Use, Share, & Disclosure your information
TerraShops shares your Personal Information with third parties to help us use such Information, as described above. For instance, we use Shopify to power our online store—to learn more about how Shopify uses your Personal Information, checkout this link: https://www.shopify.com/legal/privacy.
We also use Google Analytics in helping us to understand how our customers use and interact with the Site – learn more about how Google uses your Personal Information here: https://www.google.com/intl/en/policies/privacy/. Lastly, we may be required to disclose your Personal Information in compliance with applicable laws and regulations, to respond to a subpoena/court order, search warrant or other lawful request for information which we may receive. We may also do so to protect our legal rights.

Should we receive a lawful, verified request for a member’s records or information in any of the limited circumstances described above, we may disclose personal information, which may include, but may not be limited to, a member’s name, address, phone number, email address, and company name. - Affiliated Businesses: We work closely with a variety of businesses to ensure the performance and improvement of the TerraShops Services. Bear in mind that these businesses may sell products or services to you via the TerraShops Services or, with your permission, offer promotional materials/content (including email promotions) to you. TerraShops also offer services or sell products jointly with affiliated businesses – including providing you the chance to register with such partners and allow them to market more effectively to you.
TerraShops is a global company, and we operate in various countries worldwide. Therefore, you agree that by using our Services, you understand that The United States, European Economic Area (“EEA”) Member States, and all other countries worldwide have different laws. When your information is transferred from your country of residence to another country, privacy and data protection laws and regulations that protect you in your country may be different from those in the country where you live. For instance, if you are in the US, and law enforcement need access to your information, this will be obtained according to US law.
At TerraShops, we rely separately, alternatively, and independently on the following legal bases to transfer your information (this is to the extent that we are deemed to transfer personal information outside of the EEA):
The “Model Clauses” adopted by the European Commission are standard contractual clauses which safeguard personal information that is transferred outside of Europe. We usually utilize these Model Clauses when transferring personal information outside of Europe.

We value the security of your personal information; and in the light of this, we take active steps in following generally accepted industry standards to protect your personal information which you have with us. One of the ways by which we keep you covered is through encryption – this is commonly used in protecting your credit card details. Please note that, no method of transmission of data via the internet or method of electronic storage is flawlessly secure. Therefore, while we do all we can to keep your personal information safe, we cannot guarantee its total security.
Your account is protected by a password. We therefore urge you to protect your account from unauthorized access by choosing a strong password which you can easily remember and signing out after using the TerraShops Services.
We will retain your information for as long as is necessary for the objectives spelt out in this policy, for as long as your TerraShops account is active (i.e., for the lifetime of your TerraShops member account), or as needed to provide the Services to you. You are at liberty to close your account if you no longer want TerraShops to use your information in providing the Services to you. Your information will be retained and used to the extent necessary to comply with our legal obligations (for instance, if we are mandated to retain your information in compliance with applicable tax/revenue laws), to resolve disputes, enforce our agreements, and as otherwise described in this policy.
Similarly, sellers on TerraShops may also be required to retain and use your information in compliance with their own legal obligations. Please be aware that closing your account may not free up your email address, username, or shop name (if any) to be reused in opening a new account. In addition, we also retain log files (for a period of time except where used for site improvement, safety and security) for internal analysis purposes. We may also retain them for longer periods where we are legally obligated to do so.
Your Rights & Choices
If you are a European resident, you have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact us through [email protected].
Additionally, if you are resident in Europe, note that we are processing your information in order to fulfill contracts we might have with you (for instance, if you purchase an order via the TerraShops Site), or otherwise to guarantee our legitimate business interests which we have listed above. Furthermore, take note that your information will be transferred outside of Europe – this includes to Canada and the United States.
Specific privacy laws in different countries around the world, including the European General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA), provide users with rights related to the processing and use of their personal information. In accordance with those laws, you have the choice to access, edit, or even remove certain information, and also choices about us contacting you. If you wish to change or correct or remove any part of your TerraShops account information, contact us through [email protected]. You are also at liberty to request the permanent closure of your account and to delete your personal data. You may also, depending on your location, enjoy a variety of rights in connection with your information. Please note that although some of these rights apply generally, some specific rights apply in limited cases.
Additional Rights provided by the CCPA to residents in California:
If you wish to manage, change or alter, limit, or delete your personal information, you can do so through your TerraShops account settings. You are free to exercise any of the rights above by contacting us through [email protected]. Note that we may need to verify your identity using government issued or other forms of identification. If you wish to designate someone else to exercise this right on your behalf, you must provide a valid power of attorney, the requester’s valid government issued identification, and the authorized agent’s valid government issued identification, and we may verify the authenticity of your request to exercise this right directly with you.
Email & Messages
You are at liberty to control the types of communications which we can have with you through your account settings. We may send you messages about the Services or your activity while interacting with the Services. Some messages are required or service related (e.g. legal notices), while others are optional such as newsletters. If you wish to discontinue the use of the Services or want to stop receiving service-related messages (except for legally required notices), you can close your account by contacting us through [email protected].

Third Party Marketing and Advertising and Your Rights (Opt-Out of “Sale”)
We do not sell personal information to anyone for money or monetary value. However, the term “sale” is defined broadly under the California Consumer Privacy Act. To the extent that the CCPA interprets “sale” to include interest based advertising or other data uses, we will comply with the applicable law as to those activities. You can opt-out by doing so through your account privacy settings or the general privacy settings link at the foot of our homepage and most pages on our Site (the right to opt-out of interest based advertising is available to every TerraShops member).
Do Not Track Signals
You may be able to automatically transmit a “Do Not Track” signal to online services you visit through your browser settings. Bear in mind that, although there is no acceptable industry consensus as to what site and app operators should do with regard to these signals. In the light of this, we do not monitor or act with respect to “Do Not Track’ signals unless and until the law is interpreted to require us to do so, we do not monitor or take action with respect to “Do Not Track” signals.
